El gobierno Español quiere excluir a los perros de caza de la Ley de Bienestar Animal

Muchos de nosotros pensamos que la nueva ley de protección animal promovida por el gobierno español era un acercamiento a la modernidad, un ejercicio de sentido común, trabajo en equipo, e independencia. En su día publiqué los puntos más destacados de esta ley, y por qué nos parecía una victoria. Pero las presiones de las minorías cazadoras parecen estar haciendo mella en la voluntad del PSOE por representar el parecer mayoritario: mejorar los derechos que salvaguardan la vida y la dignidad de los animales. Ahora los socialistas quieren enmendar esta ley y dejar fuera de la misma a los perros de caza y de trabajo.

Este cambio de rumbo es una concesión clara al lobby de la caza, que pretende seguir utilizando a los perros como herramientas, en lugar de como seres sintientes, pudiendo deshacerse de ellos cuando no cumplen con las expectativas de sus dueños. Me pregunto, cuál es la lógica de esta diferenciación en el nivel de protección entre un perro, digamos un galgo, siendo mascota y el mismo perro en manos de un cazador.

Por eso, para tratar de frenar este sinsentido, y concienciar a la gente de que su opinión es importante se ha lanzado la campaña #MismosPerrosMismaLey, a la cual os invito a uniros, como han hecho ya miles de personas.

¿Qué podemos hacer?

HOY

Hoy día 6 de Octubre, se presentan enmiendas a la totalidad de la ley de protección animal por parte de los partidos PP, VOX y PNV. Parece que estas objeciones a la ley no saldrán, dado que no tienen los apoyos. Quizá uno de sus argumentos sea el presunto conflicto entre esta ley y las leyes autonómicas. Esto, en mi opinión y la de muchos con los que he hablado, carece de fundamento porque solamente una ley estatal es capaz de luchar con el maltrato endémico que sufren algunos animales en España. Hoy es buen momento de llenar las redes con el hashtag #MismosPerrosMismaLey y vuestra opinión al respecto. Hoy es el día para llenar Twitter, y todas las demás redes con esto!

ORGANÍZATE

Se están organizando pequeñas protestas frente a las sedes del PSOE, no más de 20 personas para no considerar dichas agrupaciones manifestaciones ilegales, con pancartas y mensajes en contra de la intención del PSOE de enmendar la ley. Si te parece, busca la sede del PSOE más cercana a ti, y organiza a tus amigos para demostrar vuestro parecer.

MANIFESTACIONES

El domingo 16 a las 12h hay varias manifestaciones. Las ciudades confirmadas son Madrid y Barcelona. Parece que habrá otra en Sevilla que aún está pendiente de confirmar. Puedes consultar toda esta información en uno de los grupos más activos por la causa Plataforma NAC.

VOTACIÒN FINAL

En la tercera semana de Octubre, el PSOE, el partido de Pedro Sanchez, presentará su enmienda para excluir a los perros de caza de la Ley de Bienestar Animal. Si tienen éxito la ley reducirá su protección solamente a "aquellos animales domésticos que viven en el domicilio familiar", algo que carece totalmente de fundamentación científica y jurídica. Estimado Srs.:

Deseo trasladar mi más profundo rechazo por el anuncio por parte de su grupo político de una enmienda a la Proyecto de Ley de Protección, Derechos y Bienestar de los Animales por la que pretenden excluir a los perros empleados en actividades cinegéticas del ámbito de aplicación del Proyecto de Ley presentado por la Dirección General de los Derechos de los Derechos de los Animales dependiente del Ministerio de Asuntos Sociales y Agenda 2030.

La pretensión de excluir a los perros empleados en actividades cinegéticas del ámbito de aplicación del Anteproyecto no se sostiene desde la perspectiva científica, ni considerado desde una visión biológica ni desde un punto de vista veterinario o sanitario. El perro como especie presenta una unicidad en sus características biológicas, sanitarias y etológicas independientemente de la función social o económica que desempeñe por lo que las medidas a adoptar para garantizar su bienestar, la seguridad o la sanidad pública deben contemplarse de forma unitaria en un solo cuerpo legislativo. De hecho, en el Reglamento Europeo de Sanidad Animal, Reglamento UE 429/2016, todos los perros, independientemente de su función o uso, se encuentran introducidos en el mismo Anexo I, la misma Parte A y bajo un único epígrafe “Canis Lupus Familiaris”. Es la opción lógica y la única con sentido y justificación científica.

Al margen de consideraciones científicas y jurídicas nuestra firme oposición a la exclusión de este tipo de perros del encuadre de protección genérico que garantiza el Proyecto de Ley está plenamente justificado por su especial necesidad, pertinencia y urgencia. Los casos de problemas de bienestar animal que afectan a perros empleados en la caza son muy numerosos y tanto estos problemas como los elevados porcentajes de abandono que se producen en nuestro país están directamente vinculados a la excesiva permisividad que hasta ahora ha imperado en las condiciones de uso y mantenimiento de estos animales. No se trata de demonizar ni estigmatizar ninguna actividad lúdica legal pero sí de encajar en el marco legal genérico que le corresponda. Para aquellas personas, incluidos cazadores, que mantienen de forma correcta a sus animales, el cumplimiento del Proyecto de Ley no supondrá ningún esfuerzo, ya lo están haciendo. Pero para aquellos que aún no lo hacen ya es hora de acabar con las prerrogativas y la excepcionalidad que les ha permitido hasta ahora vivir en una permisividad jurídica especial. Todos los propietarios de perros deben estar sujetos a las mismas obligaciones genéricas y todos los perros deben disfrutar de las mismas garantías legales. Es la única manera de acabar con situaciones como las que reflejamos en las siguientes fotografías:

A lo largo de toda la elaboración de esta nueva ley de protección animal, el lobby de la caza, a través del Ministerio de Agricultura, ha ejercido una incesante presión con el objetivo de que los perros utilizados para la actividad cinegética, entre otros, quedarán excluidos de las previsiones de dicha ley.

Esperamos que nos ayudéis a visibilizar el sentimiento mayoritario de indignación ante el sometimiento de nuestros procesos, y resultados, de la actividad democrática a los intereses de unos pocos.

Help the Spanish hunting dogs

Many consider that the new animal protection law, promoted by the Spanish government, was an approach to modernity and a victory for animal welfare. But the pressures of the hunting lobby appear to be making a dent in the will of the Spanish government to represent the opinion of most people, which is to improve the rights that safeguard the life and dignity of animals. So now, the socialists (PSOE), and the government, want to amend their own law and leave hunting and working dogs out of it.

This change, of course, is an explicit concession to the hunting lobby, which intends to continue using dogs as tools rather than as sentient beings and dispose of them whenever they want.

Therefore, to try to stop this nonsense and make people aware that their opinion is necessary, the #MismosPerrosMismaLey campaign has been launched. I invite you to join, as thousands of people have already done.

What can we do?

TODAY

Today, October 6, the PP, VOX, and PNV parties present amendments to the entire animal protection law. These objections to the law will not come out since they lack support. Perhaps one of their arguments is the presumed conflict between this law and the autonomous laws. This, in my opinion, and that of many I have spoken to, is unfounded because only state law can combat the endemic mistreatment of some animals in Spain. Therefore, today is an excellent time to fill the networks with the hashtag #MismosPerrosMismaLey and your opinion on the matter. Let´s call it Twitter storm!

GET ORGANIZED

Small protests are being organized in front of PSOEs headquarters, with no more than 20 people so as not to consider these gatherings as illegal group demonstrations. People will meet with banners and messages against the PSOE's intention to amend the law.

MANIFESTATIONS

On Sunday, October 16 at 12h there are confirmed demonstrations in Madrid and Barcelona. There seems to be another one in Seville that is still pending confirmation. You can consult all this information on Plataforma NAC´s webpage.

FINAL VOTE

In the third week of October, the PSOE will present its amendment to exclude hunting dogs from the Animal Welfare Law. If they succeed, the law will only cover "those domestic animals that live in the family home," a distinction that lacks scientific and legal foundation. Dear Sirs:

I wish to convey my deepest rejection of the announcement by your political group of an amendment to the Bill for the Protection, Rights, and Welfare of Animals by which they intend to exclude dogs used in hunting activities from the scope of application of the Bill of Law presented by the General Directorate of the Rights of Animals dependent on the Ministry of Social Affairs and Agenda 2030.

The claim to exclude dogs used in hunting activities from the scope of application of the Bill is not supported from a scientific perspective, nor considered from a biological point of view or a veterinary or health point of view. The dog as a species presents a uniqueness in its biological, health, and ethnological characteristics regardless of the social or economic function it performs, so the measures to be adopted to guarantee its well-being, security, or public health must be considered in a unitary way in a single legislative body. In fact, in the European Animal Health Regulation, EU Regulation 429/2016, all dogs, regardless of their function or use, are included in the same Annex I, the same Part A, and under a single heading, "Canis Lupus Familiaris." It is the logical option and the only one with sense and scientific justification.

Apart from scientific and legal considerations, our firm opposition to excluding this type of dog from the generic protection framework guaranteed by the Bill is fully justified by its particular need, relevance, and urgency. The cases of animal welfare problems that affect dogs used in hunting are very numerous, and both these problems and the high percentages of abandonment that occur in our country are directly linked to the excessive permissiveness that has prevailed in hunting conditions up to now. It is not about demonizing or stigmatizing any legal recreational activity, but it is about fitting into the general legal framework that corresponds to it. For those people, including hunters, who keep their animals correctly, compliance with the Bill will not require any effort; they are already doing it. But for those who have not yet done so, it is time to end the privileges and exceptionality that have allowed them to live in a special legal permissiveness until now. All dog owners must be subject to the same generic obligations, and all dogs must enjoy the same legal guarantees. It is the only way to end situations like the ones reflected in the following photographs:

Throughout the development of this new animal protection law, the hunting lobby, through the Ministry of Agriculture, has exerted constant pressure with the aim that the dogs used for hunting activities, among others, will remain excluded from the provisions of said law.
